A Legal Reflection on the Meaning of ‘Men’ (Rijal) in Article 115 of the Constitution

به موجب صدرِ اصل «115» قانون اساسي، رئيس جمهور بايستي از ميان رجال مذهبي و سياسي انتخاب شود. عده اي با اشاره به معناي لغويِ اين عبارت، قائل به عدم جواز قانونيِ رياست جمهوريِ زنان هستند. در مقابل، تعدادي از صاحبنظران كلمه «رجال » را به «شخصيت هاي برجسته» معنا كرده و بر اين عقيده اند كه در صورت احراز ساير شرايط مندرج در اصل «115» قانون اساسي، هيچگونه منع قانوني براي رياست جمهوري زنان وجود نخواهد داشت. در اين ميان، عدم اعلام نظريه ي تفسيري شوراي نگهبان در خصوص معناي عبارتِ مذكور، موضوع را پيچيده تر كرده است. ر اين مقاله، پس از اشاره به دلايل موافقين و مخالفين با رياست جمهوري زنان، مذاكرات مطروحه در مجلس بازنگري نهايي قانون اساسي مورد بررسي قرار گرفته و به منظور دركِ موضعِ ديگر كشورهاي اسلامي در اين رابطه، شرايط احراز پست رياست جمهوري در قوانين اساسي برخي از اين كشورها، تبيين خواهد شد. در نهايت، اين ايده مطرح مي شود كه كلمه ي رجال در اصل «115» منحصر به مردان نبوده و مي توان قائل به امكان قانونيِ رياست جمهوري زنان شد.

According to Article 115 of the Constitution, the President must be elected from religious and political men (rijal). Some people, referring to the literal meaning of this article, argue that women's presidency is legally impermissible. Conversely, a number of experts have interpreted ‘Rijal’ as ‘prominent figures’ and believe that if other terms of the article are acknowledged, there will be no legal prohibition on women's presidency. Meanwhile, since Guardian Council has not declared its interpretation of the meaning of the article, the issue has been more complicated. Indicating proponents’ and opponents’ reasons for the women's presidency, this paper will examine the raised discussions in the parliament for final revising of constitution. and in order to understand the position of other Islamic countries on this issue, the conditions of presidency authentication in the constitution of some of these countries will be explained. Finally, one can plausibly argue that the word ‘Rijal’ in the article is not exclusively denoted to men and one can consider the legal possibility of women's presidency.
