اختيارات شوهر در منع اشتغال زن در نظام حقوقي ايران

يكي از مسائلي كه ممكن است به اساس خانواده خلل وارد كند، اشتغال زن و شوهر به مشاغلي است كه به بنيان و اساس خانواده آسيب مي‌رساند. سؤال اصلي، محدودۀ اشتغال زوجه و اختيار زوج در ايجاد محدوديت براي حفظ اساس خانواده در حقوق ايران است. مقاله با روش كتابخانهاي نگاشته شده و با تأكيد بر حق اشتغال زوجه به حكم اوليه، در مواردي به شوهر اجازه داده شده است كه چنانچه اصل اشتغال زوجه يا نوع آن به اساس خانواده خللي وارد كند، بتواند زوجه را از آن نوع خاص شغل يا اصل اشتغال منع كند. اين اختيار را ميتوان در راستاي اختيارات مرد، به‌عنوان عنصر قوام‌بخش خانواده، تحليل كرد. از موارد مجاز منع اشتغال زوجه، اموري است كه به وظيفۀ زن در تشييد مباني خانواده، مساعدت در تربيت فرزندان و انجام وظيفۀ تمكين خلل وارد كند يا حيثيت و شئون خانوادگي را خدشه‌دار نمايد. نكتۀ درخور تأكيد اينكه براي جلوگيري از سوء استفادۀ احتمالي شوهر از اعمال اين حق، تقاضاي زوج و اثبات تنافي شغل انتخابي با مصالح خانواده يا حيثيت مرد يا زن و صدور حكم قضايي، لازمۀ جلوگيري از اشتغال زن به حرفۀ مغاير با وظايف و شئون خانوادگي است.
