كاربرد قاعده حفظ نظام در انديشه فقهي ـ سياسي امام خميني‌ (ره)

Application of the Principle of Preserving the System in Imam Khomeini's Jurisprudential and Political Thought

حفظ نظام اجتماعي و سياسي جامعه، مسئله‌اي است كه از ديرباز همواره مورد توجه انديشمندان حوزه‌هاي مختلف علوم اجتماعي قرار داشته است. فارغ از نوع نگرش به اين مسئله، تلاش جهت حفظ نظام اجتماعي و حتي سياسي، امري پسنديده و ايجاد اختلال در نظم و امنيت عمومي و نظام معيشت جامعه امري قبيح محسوب مي‌شود. در فقه شيعه نيز اين مسئله تحت عنوان قاعده «ضرورت حفظ نظام» و «حرمت اختلال نظام» توسط فقهاي اماميه مطرح شده و مبناي صدور حكم و اجراي آن در موارد مختلفي قرار گرفته است. حضرت امام (ره) از برجسته‌ترين فقهاي معاصري است كه توجه فراواني به جايگاه اين قاعده در منظومه فقه شيعه داشته و بهره فراواني در مرحله صدور احكام فقهي و نيز مرحله اجراي احكام در عرصه اجتماع از اين قاعده برده است. اين پژوهش به دنبال پاسخ به اين پرسش است كه قاعده ضرورت حفظ نظام چه تأثيري در مرحله صدور احكام فقهي سياسي در انديشه حضرت امام (ره) داشته است. براي پاسخ به اين پرسش، داده‌هاي لازم با استفاده از روش مطالعات كتابخانه‌اي و اسنادي و با مراجعه به آثار برجاي مانده از امام (ره) گردآوري شده و با بهره‌گيري از روش تحليلي ـ توصيفي مورد تفسير و تبيين قرار خواهد گرفت. چارچوب مفهومي مقاله نيز قاعدۀ حفظ نظام است كه در قالب چهار محور «حفظ كيان اسلام»، «حفظ نظام اجتماعي»، «حفظ نظام معيشتي» و «حفظ نظام سياسي و حكومتي» مورد بررسي قرار گرفته است. نتيجة تحقيق حاضر آن است كه مهم‌ترين ابداع ايشان نسبت به فقهاي پيش از خود، گسترش مفهومي قاعده ضرورت حفظ نظام و افزودن محور حفظ نظام سياسي به دايره شمول اين قاعده است.

Preserving the social and political system of society is a matter that has long been the subject of attention among thinkers in various fields of the social sciences. Regardless of the attitude toward this issue, trying to maintain a social and even political system is a worthwhile practice, and disturbing public order and security and the society's livelihood is considered a disgrace. In Shi'a jurisprudence, this issue has been raised by Imamia jurisprudents under the guise of the "maintaining the system" and "prohibition of creating disorder ", and has been the base of issuing sentences and its implementation in various cases. Imam Khomeini is one of the most prominent contemporary jurisprudents who has paid great attention to the position of this Shiite jurisprudential principle, and has benefited greatly from the issuance of jurisprudential rulings and their implementation. This research seeks to answer the question of how the principle of preserving the system has had an effect on the issue of political jurisprudence in Imam Khomeini's mind. It is concluded that the principle of preserving the system in the thought of Imam Khomeini is based on the four axes of "preserving the very existence of Islam," "preserving the social system", "preserving the livelihood system" and "preserving the political system"; and the most important of his inventions as compared to his predecessors, is the conceptual extension of the principle of the necessity of maintaining the system and adding the pivotal dimension of preserving the political system to the scope of this principle.
